1. Acceptance of Terms

By accessing or using the KryptoMate platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all the terms and conditions contained herein, you must discontinue use of the Service immediately. Your continued use of the Service following any changes to these Terms constitutes your acceptance of the revised Terms.

KryptoMate reserves the right to update, modify, or replace any part of these Terms at its sole discretion. It is your responsibility to check this page periodically for changes. Notification of material changes may be provided via email or through a notice on our platform, but you acknowledge that such notification is a courtesy and not a requirement.

You represent that you are at least eighteen (18) years of age or the age of majority in your jurisdiction, whichever is greater. Persons under such age are not permitted to use the Service, make purchases, or create an account under any circumstances.

2. Description of Services

KryptoMate provides an online marketplace that enables users to browse, purchase, and receive consumer electronics and accessories. The Service includes product listings, order processing, payment facilitation through cryptocurrency and fiat currencies, wallet management, and order tracking features.

KryptoMate functions as a platform connecting buyers with products sourced from verified suppliers and manufacturers. We do not manufacture the products listed on the platform unless explicitly stated. Product descriptions, specifications, and imagery are provided for informational purposes and may not always reflect the exact product received due to variations in manufacturing batches.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice. KryptoMate shall not be liable for any modification, suspension, or discontinuation of the Service.

3. User Accounts

To access certain features of the Service, you must create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information promptly if it changes. You are solely responsible for safeguarding your account credentials and for all activities that occur under your account.

You agree not to disclose your password to any third party and to notify KryptoMate immediately of any unauthorized use of your account or any other breach of security. KryptoMate cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.

KryptoMate reserves the right to suspend or terminate your account at any time, with or without cause, and with or without prior notice. Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

4. Payments and Billing

All prices displayed on the Service are listed in United States Dollars (USD) unless otherwise indicated. Prices may be displayed in local currency equivalents for convenience purposes, but the final charge will be processed in USD based on the prevailing exchange rate at the time of transaction settlement.

KryptoMate accepts payments through various methods including cryptocurrency transfers (USDT via Binance Pay) and local bank transfers (COP). By initiating a payment, you authorize KryptoMate or its third-party payment processors to charge the specified amount using your selected payment method. You represent and warrant that you have the legal right to use any payment method you provide.

All sales are subject to our Refund and Returns Policy, which is incorporated by reference into these Terms. Cryptocurrency payments are non-reversible by nature; however, refunds may be issued at KryptoMate's discretion in the form of store credit, wallet balance, or equivalent USDT return. Processing times for refunds vary by payment method.

5. Intellectual Property

The Service and its entire contents, features, and functionality — including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof — are owned by KryptoMate, its licensors, or other providers of such material and are protected by applicable copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Service without prior written consent from KryptoMate.

The KryptoMate name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of KryptoMate or its affiliates. You must not use such marks without prior written permission. All other names, logos, product and service names appearing on the Service are the trademarks of their respective owners.

6. Limitation of Liability

To the fullest extent permitted by applicable law, KryptoMate, its affiliates, officers, directors, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses resulting from your access to or use of or inability to access or use the Service.

KryptoMate's aggregate liability for any claims arising out of or relating to these Terms or the Service shall not exceed the greater of one hundred United States Dollars (USD $100.00) or the total amount paid by you to KryptoMate in the twelve (12) months preceding the event giving rise to the claim.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. KryptoMate does not warrant that the Service will be uninterrupted, secure, or error-free.

7. Termination

These Terms shall remain in full force and effect while you use the Service. You may terminate your account at any time by contacting customer support or through your account settings. Upon termination, your account will be deactivated and you will lose access to any data associated with your account, including wallet balances, order history, and wishlists.

KryptoMate may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. In cases of fraudulent activity, abuse of the platform, or violation of applicable laws, KryptoMate reserves the right to retain information for legal and investigative purposes.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Colombia, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms shall be exclusively resolved in the competent courts of Bogotá, D.C., Colombia.

You agree that any claim or cause of action arising out of or related to these Terms or the use of the Service must be filed within one (1) year after such claim or cause of action arose, or be forever barred. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms.

9. Changes to Terms

KryptoMate reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least thirty (30) days' notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, you must stop using the Service. We encourage you to review these Terms periodically for any updates or changes.
